Center of Legal Assistance (CLAW) together with partners from Republic of Srpska implemented the project “Trial Monitoring towards achieving sexual and gender equality in BiH”. Trial monitoring of criminal proceedings in cases of sexual and gender based violence cases was conducted on 20 courts. Out of 227 monitored cases in 156 cases sanctions were imposed and cases are closed. The majority of sentences were in form of suspended sentence, 101 of them (65%).
It has not been recorded a single case were protective measures were imposed, although circumstances suggested that they were necessary. Criminal sanctions for the cases of SGBV in general are mild, on the legal limit, and sometimes below the legal limit described by the law.
When it comes to penal policy more mitigating circumstances are more often taken into account than aggravating ones, and without any explanation. Report and analysis with recommendations can be found HERE.
